By using the LPA Advice Company’s Service you agree to the following terms and conditions. Please read them carefully.


1. General


1.1 These Terms and Conditions affect your rights and liabilities under the law. They govern your use of, and relationship with, our online Lasting Power of Attorney Service.


2. Applicable Law


2.1 The Laws of England and Wales are at all times applicable to the use of this Service, including any dispute arising from its use.


3. Definitions


3.1 'LPA' means a Lasting Power of Attorney document;

3.2 'Service' means the work we agree to undertake on your behalf in creating and delivering to you a tailored Lasting Power of Attorney using the information you provide to us via our online questionnaire and any subsequent amendments which may be required to ensure the documentation created meets your requirements. 'Service' does not include the registration of your LPA with the Office of the Public Guardian (OPG);

3.3 'We', 'us' or 'our' means the LPA Advice Company;

3.4 'You' or 'your' means the person to whom we are providing our Services;

3.5 'Parties' is a reference to both us and you;

3.6 'Website' means www.lpaadvice.co.uk


4. Contract for Service, including Cancellation Rights


4.1 In paying to use our Service, you will automatically enter into a legally binding contract with us, whereby you agree to the Obligations detailed in Condition 5, and we agree to the Obligations detailed in Condition 6;

4.2 We will notify you upon receipt of payment;

4.3 We reserve the right to charge an additional £25 administration fee per LPA for any subsequent material changes you request after a period of 14 days following first email receipt of completed LPA;

4.4. Pursuant to section 28(1)(b) of The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 there is no automatic right to cancel this contract once work has begun due to the tailored, personalised content;

4.5 Subject to Condition 4.5, a refund will not be provided should you wish to cancel after the Service has commenced;

4.6 Should you be unhappy with the content of your completed LPA for any reasonable reason (a simple 'change of mind' is excluded hereunder) which cannot be adequately addressed by us, we have the discretion to agree to a full refund;

4.7 Upon cancellation of the contract under Conditions 4.4 - 4.7, your payment will be refunded within 28 days of cancellation.


5. Your Obligations


5.1. In agreeing to use our Service, you must –

5.1.1. read and acknowledge that you agree to these terms and conditions;

5.1.2. provide a valid email address for receipt of the LPA documentation and to address any email queries we may have in order to complete our tailored LPA;

5.1.3. keep your sign-in details safe;

5.1.4. not leave your computer, if shared or public, unattended while signed in to the Service;

5.1.5. fully acknowledge that it is your obligation to ensure that the answers you give to our online questionnaire are made without undue influence or coercion from any other party and that the information you provide is made with your own free will;

5.1.6. fully and accurately complete our online questionnaire and answer any supplemental questions we may have;

5.1.7. understand and acknowledge that it is your responsibility to provide us with the correct details (including, but not limited to, information regarding the identity of any parties, their age and capacity);

5.1.8. acknowledge that the accuracy and efficiency of our Service is dependent upon your answers to our online questionnaire;

5.1.9. check through your LPA carefully as soon as possible upon receipt to ensure it is accurate and in accordance with the information you have provided;

5.1.10. contact us as soon as possible to notify us of any changes to your LPA required (please also refer to Conditions 4.3 and 6.19);

5.1.11. ensure you carefully follow the steps outlined in the Checklist received with your LPA before attempting to register your LPA with the OPG;

5.1.12. only register the LPA with the OPG if you are happy with the content of your LPA. Please also refer to Condition 6.1.9 below;

5.1.13. only access or view the information contained within our website through a standard internet browser (such as Firefox, Internet Explorer, Safari or Opera);

5.1.14. not use any software or device to copy, transfer or download complete or partial parts of the information provided within our website (text, code, software, graphics etc) to enable you or another person to run or adversely affect our website.


6. Our Obligations


6.1. When you agree to use our Service, we will –

6.1.1. not share your personal details, information or preferences with any third party without your permission;

6.1.2. ensure that we keep the information you provide to us safe and secure as far as reasonably practicable, and for no longer than is reasonably necessary (subject to the provisions of section 9);

6.1.3. provide you with our Service using all reasonable skill and care;

6.1.4. comply with the laws and regulations in force at the time of providing you with our Service;

6.1.5. upon receipt of your payment of our fee in full, we will provide you with your completed LPA within a reasonable period of time following a full response by you to any queries we may have;

6.1.6. ensure your completed LPA is an accurate reflection of the information you provide us via the online questionnaire;

6.1.7. use all reasonable and timely endeavours to rectify any errors or changes required to the completed LPA;

6.1.8. take all reasonable efforts to ensure that our website and Service is available for use;

6.1.9. securely retain all information you provide us (whether via the online questionnaire or email) for no longer than is reasonably necessary. To this extent, we reserve the right to delete all information held on your behalf after a period of four years.


7. Online Payment


7.1 After completing the online questionnaire, you will need to make the online payment in order for us to prepare your tailored Lasting Power of Attorney. We cannot provide you with our Service until this fee has been paid;

7.2 In agreeing to make the payment, you will be redirected to our payment partner, Stripe, for the payment to be processed;

7.3 The details you give them will be encrypted, in line with the Payment Card Industry Data Security Standard (PCI-DSS);

7.4 We will not store any of your payment card details;

7.5 We are not liable for any information you enter into Stripe's pages, or for the availability of the Stripe site;

7.6 To pay online you must abide by Stripe's terms and conditions, which you can read here along with their privacy policy:

8. Data Protection and Privacy


8.1 We comply with all principles of the Data Protection Act 1998;

8.2 The information you enter into the online questionnaire is not transmitted to any third parties;

8.3 You remain the owner of all information provided to us, which is stored in our secure database for a period of four years or until such time as you ask in writing that we securely delete your data;

8.4 You have the right to request details of any information we hold on your behalf, to include information and or data you have submitted to us via the online questionnaire and or email;

8.5 Anyone who believes their personal data is kept within the service has the right to submit a subject access request to us as long as disclosing that information does not breach the privacy rights of any other parties;

8.6 If a subject access request shows that the information is inaccurate, we will amend or delete any information we hold as requested within 5 working days. In these circumstances, we will warn the registered user first by email.


9. Disclaimer


9.1 This website is owned by a private limited company, 'LPA Advice Company'. We are not affiliated with the OPG or any other government organisation;

9.2 We do not accept liability for loss or damage incurred by users of this Service, whether direct, indirect or consequential, whether caused by tort, breach of contract or otherwise. This includes loss of income or revenue, business, profits or contracts, anticipated savings, data, goodwill, tangible property or wasted time in connection with this Service or any websites linked to it and any materials posted on it;

9.3 This does not affect our liability for fraudulent misrepresentation or misrepresentation as to a fundamental matter, nor any other liability which cannot be excluded or limited under applicable law;

9.4 Data and material found on our website is provided only for generic advice to enable you to gain a general understanding of the topics and issues to which it relates. It shall not be considered or construed as legal advice;

9.5 Whilst we will make every reasonable endeavour to ensure the accuracy of the information and data displayed on our website, this may not be up-to-date or provide all the relevant material or data concerning the topic or issues it addresses at all material times and therefore must not be solely relied upon as a source of information;

9.6 We do not accept any responsibility for any third party websites which may be linked to our Website. You accept that by clicking on such links you do so at entirely your own responsibility and risk;

9.7 We may occasionally update these Terms and Conditions in line with any changes to the law or the way in which our Service works;

9.8 We will have the right to correct any errors or omissions to our website (and this right includes the right to change any of the documentation which forms part of our Services), as long such correction is minor and does not materially affect our Services;

9.9 The LPA Advice Company cannot confirm the content or reliability of any linked websites and does not necessarily endorse any views expressed therein;

9.10 Whilst the LPA Advice Company makes every effort to ensure this Service is accessible at all times, we are not liable if the website or Service is unavailable for any period of time.
